The gambling legislation in India is based on the Public Gaming Act of 1867. Because the laws are so old, there is also a lot of space for interpretation. One article of this legislation states that “12. Act not to apply to certain games. Nothing in the preceding provisions of this Act contained shall be held to apply to any game of mere skill wherever played”.

This definition states that “…gambling includes any activity or undertaking whose determination is controlled or influenced by chance or accident or any activity or undertaking which is entered into or undertaken with the consciousness of the risk of winning or losing (e.g., prize competitions, a wagering contract)…”.
In the past years, casino gambling was allowed in hotels, and there are also several land-based casinos that are functional in India. But there is no surprise that the Public Gaming Act of 1867 doesn’t refer to online gambling at all. There is no Indian law that bans online casinos from functioning just the way they want to.
However, in the state of Maharashtra, online gambling is banned by the low. In the state of Sikkim, online gambling is regulated by the government, which can offer certificates to websites that want to offer gambling options to customers.
Based on this information, gambling in India is something that takes place. You can gamble as much as you want because the legislation is unclear. The exceptions are the states that banned gambling altogether.
